1. Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of the Healers Tab clinic management and electronic medical records platform, operated by FALCON EBIZ PRIVATE LIMITED (“Healers Tab”, “we”, “us”, “our”). By creating an account, starting a free trial, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you are agreeing on behalf of a clinic or organisation, you represent that you are authorised to bind it.
2. Definitions
- Service — the Healers Tab software, websites, applications and related features.
- Customer / Clinic — the clinic, practice or organisation that holds the account.
- User — a person the Customer authorises to use the Service.
- Patient Data — information about the Customer’s patients entered into the Service.
- Subscription — a paid plan for the Service.
3. Eligibility & account
You must be at least 18 years old and able to enter into a binding contract. You agree to provide accurate registration information, keep your login credentials secure, and remain responsible for all activity under your account. Notify us promptly of any unauthorised use.
4. The service & licence
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your subscription. We may update, improve or modify features over time. All rights not expressly granted are reserved.
5. Free trial
We may offer a free trial (currently 14 days) that provides access to features without requiring payment details up front. At the end of the trial, you must subscribe to a paid plan to continue using the Service. We may change or withdraw trial offers at any time. Data created during a trial may be deleted if you do not subscribe within a reasonable period after the trial ends.
6. Subscriptions, fees & billing
Paid plans are billed per clinic, per billing period (monthly or yearly), at the prices shown at signup or on your billing page. Fees are exclusive of taxes unless stated; applicable GST will be added and reflected on your invoice. Payments are collected through third-party payment gateways. Unless cancelled, subscriptions renew automatically for successive periods, and you authorise us (through our payment partners) to charge the applicable fees on each renewal. You are responsible for keeping your payment details valid. We may revise pricing on prospective notice. Cancellations and refunds are governed by our Refund & Cancellation Policy.
7. Your responsibilities
- You are solely responsible for the accuracy, legality and quality of all data you enter, including Patient Data, and for the clinical decisions, diagnoses, prescriptions and advice recorded using the Service.
- You must obtain and maintain all consents and authorisations required from patients and others before entering their data into the Service, and comply with all laws and professional and ethical standards applicable to your practice.
- You are responsible for configuring user roles and access appropriately and for the acts and omissions of your Users.
- You should maintain your own backups or exports where required by law and not rely solely on the Service.
8. Acceptable use
You agree not to: use the Service for any unlawful, infringing, harmful or fraudulent purpose; attempt to breach security or access another Clinic’s data; reverse-engineer, scrape, or overload the Service; upload malicious code; or use the Service to send unlawful or unsolicited communications. Use of SMS and email features must comply with applicable communication regulations.
9. Intellectual property
The Service — including its software, design and content (excluding your data) — is owned by Healers Tab and its licensors and is protected by law. We retain all rights not expressly granted. You retain all rights to your data and Patient Data.
10. Your data & privacy
Your use of the Service is also governed by our Privacy Policy. As between you and us, you (and, for patient records, the relevant Clinic) own your data. You grant us the limited rights needed to host, process and display the data to provide the Service. We act as a processor for Patient Data, processing it on your instructions.
11. Service availability & support
We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance (which we try to schedule and announce in advance) or due to factors beyond our control. Support is provided through the channels we make available from time to time.
12. Third-party services
The Service integrates third-party services such as payment gateways and SMS and email providers. Your use of those services may be subject to their own terms, and we are not responsible for them.

The Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, to the maximum extent permitted by law.
15. Limitation of liability
To the maximum extent permitted by law, Healers Tab and its affiliates, officers and employees will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data, goodwill or business. Our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the fees you paid to us for the Service in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
16. Indemnification
You will indemnify and hold harmless Healers Tab from claims, damages and expenses arising out of your data, your use of the Service, your breach of these Terms, or your violation of any law or the rights of any person, including patients.
17. Suspension & termination
You may cancel your subscription at any time as described in our Refund & Cancellation Policy. We may suspend or terminate access if you breach these Terms, fail to pay, use the Service unlawfully, or where needed to protect the Service or others. On termination, your right to use the Service ends. We will make your data available for export for a limited period after termination, after which it may be deleted in line with our Privacy Policy.
18. Changes to the terms
We may update these Terms from time to time. Material changes will be notified, and the “Last updated” date will change. Continued use of the Service after changes take effect constitutes acceptance.
19. Governing law & disputes
These Terms are governed by the laws of India. Subject to applicable law, the courts at [City], India will have exclusive jurisdiction, and you and we submit to that jurisdiction.
